Is she legally obligated to return the promise ring?

promise ring
Martin M asked:

I got my ex-girlfriend a promise ring and we have since split. I want the ring back. Is there any legal premise where she is obligated to give it back to me?

  1. The general rule… if it was a gift given at a holiday as a Christmas, birthday, or anniversary gift, it remains a gift and is hers.

If it was given for no reason, other than the promise, it is yours once she breaks the promise.

  2. Nope. A gift is a gift. It has no expiration date or obligations.

  3. If it had been an engagement ring, she would be required to give it back. That would be a gift of condition.

Since it was a gift and no condition is truly attached, then she is probably not obligated to give it back.

  4. Who broke the promise?

  5. No quite the opposite dude.

Legally, it is a gift, and hers to do what she pleases with.

Maybe you can buy it back when she puts it on eBay :)
What would you do with it, give it to the next girl? She will be happy to have a used ring!

Or do you just want to punish her somehow by not having a remembrance of when times were good?

Just let it go! We’ve all been there, so welcome to the club.
